These terms and conditions create the legal base for any services and offers provided by Flying Steps Academy, subsequently FSA. Any changes to these conditions are not valid without the written approval of FSA. GTC are accepted with the registration as well as with the participation in the classes on offer at FSA. If not declared differently in the respective contracts, the GTC are applicable to any use of the premises, classes and offers of FSA, irrespective of place, time and the circumstances how they are operated.
§ 1 Definitions
The beneficiary of contract or their legal representatives are subsequently called “participant”. The participation in any dancing offers of FSA, subsequently called “classes”, are validated via so called tickets. A ticket is a digital product.
§ 2 Regulations of Participation
In order to participate in the offers of FSA, a prior registration via the website of FSA (http://www.flyingsteps-academy.de/registrierung/) is mandatory. The participation in classes of FSA can be booked up to four weeks in advance either via telephone, via the FSA website http://www.flyingsteps-academy.de/classes/ or via the FSA app. The booking can be cancelled free of charge up to 60 minutes before the beginning of class (early cancellation). As later cancellations will not be considered, one ticket unit will be deducted from the account.
§ 3 Offers and Services of FSA
Course fees valid on the date of registration do apply (prices are published on the FSA website www.flyingsteps-academy.de/classes). Fees are subject to change, prices include VAT. Flying Steps Entertainment GmbH reserves the right to adjust prices according to varying VAT rates. Classes are eligible for different levels and target groups – the class schedule on the website provides recommendations. Exceptions are possible given the fact that the FSA or the respective coach agrees.
3.1. Single Tickets
A Single Ticket corresponds to a single visit of a dance class in the premises of FSA. It is valid for six months from the date of purchase. Tickets cannot be used any more after this period of time. Single Tickets can be purchased via the FSA online shop. Respective conditions apply.
Vouchers can be purchased on site or via the FSA online shop. Respective conditions apply. Vouchers are valid for all classes on offer, they can be activated within 6 months from the date of purchase. The date of activation is the date of the first participation in a class. Vouchers or the equivalent amount of tickets are valid for 6 months.
3.3. 8 Tickets
The purchase of 8 Tickets entitles the buyer to participate in eight classes of their own choice. Validity expires after 6 months and tickets can not be used any more. Tickets are non-transferable.
3.4. 30 Days Flat Rate
The 30 Days Flat Rate entitles the buyer to participate in any of the classes offered by FSA on an unlimited level within a validity of 30 days, stating on the date of activation. It is possible to set the date of activation into the future. Classes are subject to restrictions based on age and level of knowledge. The 30 Days Flat Rate can be purchased on site as well as via the FSA online shop. Respective conditions apply.
Prerequisite to an effective subscription is a complete contract form with signature of the participant or their legal representatives in due form. The participant can choose between three different models: S, M and L. Subscriptions are valid for a three months period. If the contract is not cancelled in written form with a two months notice, the subscription automatically renews for another term of three months. The allotted amount of tickets, subscription S: 13 tickets, subscription M: 26 tickets, is valid only in the respective time frame of the subscription. The participant can individually choose for which class and in which frequency tickets are used. Tickets lose validity if not used within the respective time period of the subscription. Subscription model L comprises an unlimited amount of tickets. For all subscriptions, booking of classes is possible via the online tool or the app. The payment is executed via monthly direct debiting of the respective partial amounts. If payment on site or payment via bank transfer is the chosen payment method, the whole sum for the respective term has to be paid in advance.
In case of confirmed sickness or long-term absence, participants with a subscription L model can exceptionally pause their participation up to four weeks or transfer the subscription to another client if approved by the FSA head office. An application in written form including the contact details of the client who will replace the original participant has to be handed in to the Academy head office.
The purchase of annual subscriptions is only possible via the online shop. Respective conditions apply. Three models are available: S, M, and L. Annual subscriptions comprise a duration of one year, valid from the date of activation, no further notice is required as they terminate automatically. The validity starts with the date of purchase. It is possible to set the activation date to another date than the date of purchase. The respective amount of tickets, for subscription model S 13 tickets, model M 26 tickets are valid for three months will be allotted to the account every three months, summing total of 4 times. Participants are free to choose the frequency as well as and style of class they like to take. Remaining ticket balance expire if not used in the respective period of time. The subscription model L encompasses an unlimited amount of tickets. § 4 Course Fees / Payment Methods
Prices are published on the webpage. The offers and services of FSA can be paid on site via cash, debit card or credit card. For three months subscriptions and annual subscriptions, the proportionate amount for the respective period of time has to be paid in advance. If a payment scheme on monthly basis is chosen, the proportionate amount will be deducted in the beginning of the respective month. In case of a return debit note, a service charge of 8,00 € is due. Direct debit payment will be paused until the balance is covered. The participant is obliged to provide new bank data in written form in case account details change.
§ 5 Termination of Contract
If cancellation is not concluded within a two months notice, the subscription automatically renews according to the respective period of time. It is mandatory to file the request for termination in written form. The request can be send via a) registered mail, b) fax (with notice of receipt) or c) e-mail (signed scan of cancellation request as attachment) to the following address:

Extraordinary termination rights come into effect in case of serious illness or confirmed change of location. In order to process the request, an appropriate proof (medical certificate, doctor’s certificate) is needed. Remaining tickets of the subscription expire with the termination of the subscription. FSA reserves the right to terminate the subscription without notice in case rules of conduct are violated. Claims for refunds of fees are not possible.
§ 6 Amendment of Subscription
Requests for amendments of subscriptions need to be in written form and afford a valid signature (minors need the signature of parents or legal guardians). The amendment of a subscription (extension of subscription) can start with the beginning of the subsequent month. A down grade of a subscription is treated like a termination. The down grade will come into effect only by the end of the subscription period with a two month notice before its end.
§ 7 Guarantee and Insurance
FSA is open throughout the year, irrespective of public or school holidays. Exceptional closings like exclusive events will be announced online. The current class schedule is valid.
FSA is free to chose, engage, and replace class trainers and coaches.
Trainers and coaches design their classes independently.
FSA remains closed during the official christmas holidays of the state of Berlin.
During summer holidays in the state of Berlin, FSA reserves the right to change the class schedule up to four weeks. The holiday schedule will be published online at least four weeks before coming into effect.
In case if a member cannot take part in any class due to a long term illness of more than four weeks, the remaining amount of tickets can be redeemed later on as the subscription will be paused for the respective period of time. This is only possible with a valid medical certificate.
The member assures to immediately provide new address and/or contact details in case of change.
Participants are obliged to follow orders of trainers and coaches. The signing member or their respective legal representatives (parents or legal guardians) are held liable for any damage caused by them through inadequate usage of provisions on site.
§ 8 Health Conditions
The participant or their respective legal representative herewith declares that their health condition is immaculate and in no objection to take part in challenging dance classes.
In case of doubt, the participant is obliged to consult a doctor before participation. The participant is herewith notified that FSA cannot be held liable for their individual health condition or capability of taking part in the dance training. Participation is at one’s own risk.
The participant agrees to follow rules of common sense in relation to behavior in the premises and treatment of facilities and equipment. Damages are to be reported to the team immediately. Orders and instructions by the team of FSA and the respective coaches and trainers are to be followed permanently. The participant or their legal representative is to be held liable for any damages resulting out of non-appropriate usage or illicit behavior.
§ 9 Liability
FSA is not to be held liable for loss or damage of any kind of clothes, money or other valuables.
Lost and found items will be kept for four weeks and can be collected in the office of FSA.
§10 Photo and Video Recordings
FSA reserves the right to record dance classes on video for purposes of public relations, e.g. postings on social media.
Image copyrights of class participants remain untouched.
Class participants are not allowed to make photo or video recordings without the explicit permission of the coach. In case of third-party-complaints, FSA reserves the right to demand the deletion of respective material.
§11 Data Protection
According to § 33 Bundesdatenschutzgesetz, personal data will be saved in electronic form for purposes of data processing. The legal foundation constitutes the data protection law. The participant agrees to the electronic processing of his personal data. It is forbidden to forward any personal data without the explicit consent of the respective participant. The participant can file a request for deletion of his personal data after 12 months of inactivity.
§ 12 Final Clause
If any of the conditions is declared to be null and void, the remaining regulations remain untouched. For both parties, the location of jurisdiction is Berlin.
Amendments, changes or sub-agreements of this contract need to be in written form. Verbal agreements are not valid.
